ORDINANCE NO. 319

AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, REPEALING SECTION 3, CHAPTER 8, TITLE 1 OF THE IDAHO CITY CODE, PERMITTING VOLUNTARY ANNEXATION ONLY, AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, The City Council has determined that it is in the interest of the people of the city of Idaho City, and in order to protect the health, safety and welfare of the citizens of Idaho City and visitors to Idaho City,

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:

That Section 3, Chapter 8, Title 1 of the Idaho City Code is hereby repealed.

EFFECTIVE DATE:

That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 320

AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 1, CHAPTER 5, OF THE CITY CODE, CHANGING THE REGULAR MEETING DATE AND TIME FOR CITY COUNCIL MEETINGS, AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, The City Council has determined that the interests of the Citizens of Idaho City would best be served by two regular monthly meetings of the City Council;

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:

SECTION 1. That Title 1, Chapter 5, Section 1 A. of the Idaho City Code be amended to read as follows:

1-5-1: MEETINGS:

A. Regular Meetings: The Mayor and City Council shall meet in regular session at the City Hall on the second and fourth Wednesday of each month, such meetings to commence at the hour of six o'clock (6:00) P.M. During such regular sessions, the Mayor and Council may consider any and all business of the City properly brought before the Council. When a holiday recognized by the City falls on the second or forth Wednesday, the regular meeting may be moved or canceled at the direction of the City Council.

SECTION 2. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 321

AMENDED: THIS ORDINANCE CORRECTS AN ERROR IN THE LEGAL DESCRIPTION CONTAINED IN ORDINANCE NO. 321 PASSED JULY 23, 2008.

AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CORPORATE LIMITS OF IDAHO CITY, WHICH LANDS ARE LOCATED IN BOISE COUNTY, IDAHO, AND PROVIDING AN EFFECTIVE DATE THEREFORE

BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:

SECTION 1: That the lands and territory describe in the "LAND DESCRIPTION 2008 LONGPRE ANNEXATION TO IDAHO CITY 19 SEPTEMBER 2008" and the survey attached hereto, all of which lie contiguous and adjacent to the corporate limits of Idaho City are hereby annexed to the corporate limits of Idaho City, and by such annexation of said territory and all lands included therein, are hereby annexed and included within the territorial limits of the City of Idaho City.

SECTION 2: That from and after the effective date of this ordinance, all property included within the boundaries of the territory described in Section 1 hereof, and annexed to Idaho City as provided by Section 1, and all persons residing therein, shall be subject to all statutes pertaining to Idaho City and all ordinances, police regulations, taxation, and other powers of Idaho City, and all persons within the said territories annexed shall be and are entitled to all the rights and benefits as are other persons residing within the corporate limits of Idaho City.

SECTION 3: The City Clerk of Idaho City is hereby directed to file immediately after the passage and approval hereof a copy of this ordinance with the State Tax Commission and a copy with the County Recorder of Boise County, as provided by Section 63-215 and 50-223, Idaho Code.

SECTION 4: This Ordinance shall take effect and be in full force and effect from and after its passage, approval and publication according to law.

ORDINANCE NO. 321

ORDINANCE NO. 322

AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 7, CHAPTER 1, OF THE CITY CODE, PROVIDING FOR ESTABLISHMENT OF CEMETERY RULES AND REGULATIONS BY RESOLUTION, PROVIDING FOR ENFORCEMENT THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the City Council has determined that the interests of the Citizens of Idaho City would best be served by the adoption of cemetery rules and regulations to govern the care, maintenance and use of the Idaho City Cemetery.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:

that title 7, Chapter 1 of the Idaho City Code be amended to include the following:

7-1-3: CEMETERY RULES AND REGULATIONS:

The City Council is hereby authorized from time to time to make such rules and regulations for the government of the Cemetery and the care thereof as it may deem proper or expedient. Such rules shall be adopted by resolution of the City Council, and shall be available to the public for review at City Hall.

7-1-4: ENFORCEMENT; PENALTY:

Any person or persons violating any of the rules and regulations of the Idaho City Cemetery adopted by the City Council shall be guilty of a misdemeanor, and each such violation is punishable as provided in Section 1-4-1 of this Code.

That this ordinance shall by in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 323

ANNUAL APPROPRIATION ORDINANCE

FOR FISCAL YEAR 2008-2009

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR FISCAL YEAR BEGINNING OCTOBER 1, 2008, APPROPRIATING THE SUM OF $916,170.00 TO DEFRAY THE EXPENSES AND LIABILITIES OF THE CITY OF IDAHO CITY FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATION IS MADE.

Be it ordained by the Mayor and City Council of the City of Idaho City, Boise County, Idaho:

SECTION 1. That the sum of $916,170.00 be, and the same is appropriated to defray the necessary expenses and liabilities of the City of Idaho City, Boise County, Idaho for the fiscal year beginning October 1, 2008.

SECTION 2. The objects and purposes for which such appropriation is made, and the amount of each object and purpose is as follows:

ORDINANCE NO. 324

AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 6, CHAPTER 3, OF THE CITY CODE, EXTENDING RESTRICTIONS OF TRUCK TRAFFIC ON MAIN STREET AND ELK CREEK ROAD, AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, The City Council has determined that the interests of the Citizens of Idaho City would best be served by extending the weight restrictions on truck traffic on Main Street and Elk Creek Road,

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:

SECTION 1. That Title 6, Chapter 3, Sections 1, 2 and 3(A) of the Idaho City Code be amended to read as follows:

6-3-1: RESTRICTION OF TRUCK TRAFFIC: It is unlawful for the driver of any vehicle, including any trailer pulled by said vehicle, weighing twenty thousand (20,000) pounds or more to operate said vehicle on Main Street between Highway 21 and Centerville Road, or on Elk Creek Road between Centerville Road and Placer Street, within the City of Idaho City. The provisions of this Section shall not apply to emergency vehicles, rubbish pickup vehicles, street and utility service vehicles, moving vans delivering materials to, or used in connection with, a construction project on or near Main Street or Elk Creek Road in the City.

6-3-2: POSTED NOTICE: The Department of Public Works for the City is authorized and instructed to post notice of this weight restriction where appropriate on Main Street and Elk Creek Road.

6-3-3: TEMPORARY SPECIAL USE PERMIT:

A. Application; Issuance of Permit: A party may apply for a temporary special use permit allowing use of Main Street and Elk Creek Road by vehicles, including any trailer pulled by said vehicle, exceeding the twenty thousand (20,000) pound maximum provided for in this Chapter. After Consideration of such an application and hearing by the City Council, the City Council may, upon such terms and conditions as are deemed by the Council to be adequate to protect the public welfare, authorize the City Clerk to issue such a temporary special use permit.

AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 7, CHAPTER 1, OF THE CITY CODE, PROVIDING FOR THE ESTABLISHMENT OF IDAHO CITY PARKS RULES AND REGULATIONS BY RESOLUTION, PROVIDING FOR ENFORCEMENT THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, The City Council has determined that the interests of the Citizens of Idaho City would best be served by the adoption of rules and regulations to govern the care, maintenance and use of Idaho City Parks,

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:

That Title 7 of the Idaho City Code be amended to include the following new chapter, "Idaho City Parks":

7-4-1: IDAHO CITY PARKS RULES AND REGULATIONS:

The City Council is hereby authorized from time to time to make such rules and regulations for the government of Idaho City Parks and the care thereof as it may deem proper or expedient. Such rules shall be adopted by resolution of the City Council, and shall be available to the public for review at City Hall.
