FOR FISCAL YEAR 2004-2005
AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR FISCAL YEAR BEGINNING OCTOBER 1, 2004, APPROPRIATING THE SUM OF $632,708.00 TO DEFRAY THE EXPENSES AND LIABILITIES OF THE CITY OF IDAHO CITY FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATION IS MADE.
Be it ordained by the Mayor and City Council of the City of Idaho City, Boise County, Idaho:
SECTION 1. That the sum of $632,708.00 be, and the same is appropriated to defray the necessary expenses and liabilities of the City of Idaho City, Boise County, Idaho for the fiscal year beginning October 1, 2004.

ORDINANCE NO. 303
AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, REPLACING EXISTING IDAHO CITY SPEED LIMIT ORDINANCE; ADOPTION OF STATE LAW, TITLE 49; ESTABLISHING PROCEDURE FOR THE DETERMINATION OF SPEED LIMITS FOR THE COUNTY ROADS; ESTABLISHING PASSAGE BY RESOLUTION OF SPEED LIMITS FOR THE COUNTY ROADS; PROVIDING FOR PLACEMENT OF SPEED LIMIT SIGNS, STOP & YIELD SIGNS; ESTABLISHING PENALTIES FOR VIOLATION OF THIS ORDINANCE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE IDAHO CITY COUNCIL, IDAHO:
SECTION 1. This ordinance shall be known as the "Idaho City Traffic Control Ordinance," and all other ordinances and parts of ordinances and resolutions in place at the effective date of this ordinance or in conflict herewith are hereby repealed.
SECTION 2. There is hereby adopted for the purpose of establishing rules and regulations for the use of all streets and public thoroughfares of Idaho City the Idaho Motor Vehicle Laws, more particularly Title 49, Idaho Code and as the same may hereafter be revised by the Idaho Legislature or amended by the governing body, and the same is hereby adopted and incorporated as an ordinance of the City as though fully set forth at length herein.
SECTION 3. The purpose of this ordinance is to establish safe speed limits on the public streets and alleys of Idaho City, to provide for proper notice of such speed limits and to provide for proper placement of stop & yield signs.
SECTION 4. That from the effective date of this ordinance, no person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. Consistent with the foregoing, every person shall drive a safe and appropriate speed approaching and crossing an intersection or railroad grade crossing, when approaching and going around a curve, when approaching a hill crest, when traveling upon a narrow or winding roadway, and when special hazards exist with respect to pedestrians or other traffic, or by reason of weather or highway conditions.
SECTION 5. No person shall drive a vehicle at a speed greater than 20 miles per hour on any street, road, or other public way in platted subdivision unless otherwise designated herein.
SECTION 6. That the Idaho City Council, after conducting a traffic investigation and consulting with representative(s) from the Idaho City Road Department and Idaho City Police Department, are hereby authorized to establish and alter specific speed limits throughout Idaho City. The established speed limits for Idaho City will be in accordance
with the speed limit schedule adopted by resolution of the Idaho City Council. A copy of current speed limits will be on file in the Idaho City Clerk's Office.
SECTION 7. The Idaho City Road Department is hereby authorized and directed to erect and maintain speed limit signs consistent with the speed limits passed by resolution by the Idaho City Council, and to erect and maintain stop signs, yield signs, or other official traffic control devices to designate through highways or to designate intersections or other roadway junctions at which vehicular traffic or one or more of the roadways should yield, or stop and yield, before entering the intersection or junction.
SECTION 8. It shall be an infraction as defined by Idaho Code 49-110(4) for any person to violate this ordinance and the penalty for violation of this ordinance shall be by fine consistent with Rule 9 of the Idaho Infraction Rules.
SECTION 9. Ordinance No. 6-2-1 of the Idaho City Municipal Code, an ordinance providing for speed limit(s) in Idaho City, Idaho, is repealed upon the effective date of this ordinance.
SECTION 10. This Ordinance shall be in full force and effect this 10th day of February, 2004.
SECTION 11. It is the purpose and intention of the Idaho City Council to pass and promulgate every section and clause of this ordinance to end at the invalidity of any one or more of said sections or clauses shall not invalidate the remaining validations.

2002-2003 FISCAL YEAR
AN ORDINANCE OF THE CITY OF IDAHO CITY, IDAHO, AMENDING ORDINANCE NO. 295, THE APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2002, AND ENDING SEPTEMBER 31, 2003; APPROPRIATING ADDITIONAL MONIES THAT WERE RECEIVED BY THE CITY OF IDAHO CITY, IDAHO IN THE SUM OF $12,998 AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO.
SECTION 1. That Ordinance No. 295, the appropriation ordinance for the City of Idaho City, Idaho for the fiscal year commencing October 1, 2002, and ending September 31, 2003, be and the same is hereby amended as follows:
That the additional sum of $2,860 be appropriated out of the revenues from the General Fund and $10,136 be appropriated out of the revenues from the Street Fund to be used for authorized and necessary expenses.
SECTION 2. This ordinance shall be in full force and effect from and after its passage and approval.

AN ORDINANCE AMENDING TITLE 2, CHAPTER 2, PARKS AND RECREATION COMMISSION, OF THE CITY OF IDAHO CITY
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Section 2-2-3 A. (Creation; Appointment) is amended by deleting the phrase "nine (9) members" and replacing it with the phrase "seven (7) members."
SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed.

ORDINANCE NO. 299
AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING WATER ORDINANCE CREATING CONSUMPTION LIMIT FOR NON-LICENSED RECREATIONAL VEHICLE; PROVIDING A PENALTY PROVISION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, THE CITY COUNCIL FINDS THERE IS A NEED TO REGULATE WATER CONSUMPTION TAKEN FROM THE RV DUMP STATION LOCATED AT 206 WEST COMMERCIAL STREET AND THE VISITOR CENTER LOCATED AT 100 MAIN AND ANY OTHER CITY OWNED OR OPERATED PROPERTY IN IDAHO CITY, IDAHO;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That there is now created a Section 9-1-34 entitled (WATER USAGE DAILY LIMIT FOR NON-LICENSED RECREATIONAL VEHICLES) and provides the following:
A. It shall be unlawful for anyone without having first obtained a valid Recreational Vehicle sticker issued by any jurisdiction or authority to take more than ten (10) gallons of potable water per day from the RV Dump Station located at 206 West Commercial Street or from the Visitor Center located at 100 Main or from any water source located on property owned or maintained by the City of Idaho City.
B. Violation: Violation of this section after one verbal or written notice shall constitute a misdemeanor.
SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 298
AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, ADOPTING THE LATEST VERSION OF THE INTERNATIONAL BUILDING CODE, THE INTERNATIONAL RESIDENTIAL CODE, PARTS I-IV AND IX, AND THE INTERNATIONAL ENERGY CONSERVATION CODE; PROVIDING FOR SEVERABILITY; REPEALING CONFLICTING ORDINANCES AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, The City Council finds there is a need to adopt the latest version and acceptable standard building codes to promote the welfare of the citizens of Idaho City;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. Code Adoption: That the approved editions of the following nationally recognized codes, as adopted by the state of Idaho or the Idaho Building Code Board, are adopted as the official building codes of the city of Idaho City.
a) International Building Code, including all rules promulgated by the Board to provide equivalency with the provisions of the American with Disabilities Act accessibility guidelines an the federal Fair Housing Act accessibility guidelines
b) International Residential Code, parts I-IV and IX c) International Energy Conservation Code
The adopted versions of the foregoing codes shall be deemed superseded by successive versions of such codes as they are adopted or approved by the Idaho Building Code Board effective on the date such codes are made effective by the Idaho Building Code Board.
SECTION 2. Exemptions: Agricultural buildings are exempt form the building codes adopted herein but shall remain subject to placement requirements established by any applicable zoning regulations.
SECTION 3. This ordinance is hereby declared to be severable. Should any portion of this ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the ordinance before the declaration of partial invalidity.
SECTION 4. Repeal of Conflicting Provisions. All provisions of the current Municipal Code or ordinances of the City of Idaho City which conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.
SECTION 5. Effective Date. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

WHEREAS, THE CITY COUNCIL FINDS THERE IS A NEED TO AMEND THE SEWER ORDINANCE RELATIVE TO MONTHLY USER CHARGES AND DELINQUENCY NOTICE TO MAKE BILLING AND COLLECTION WITH WATER MONTHLY USER CHARGES DUE DATE AND DELINQUENCY TIME FRAME;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Section 9-2-30A (MONTHLY USER CHARGES: DUE DATE) be amended by deleting the sentence in its entirety and replacing it with the following:
"All monthly sewer charges shall be due and payable from the customer to the City Clerk within fifteen (15) days of the issuance of the bill for services."
SECTION 2. That Section 9-2-31A (DELINQUENCY NOTICE: DEEMED DELINQUENT) be amended by deleting the sentence in its entirety and replacing it with the following:
" Upon the customer's failure to pay the monthly charges within fifteen (15) days as prescribed, the sewer bill will be considered delinquent."
SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 4. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.
