AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR FISCAL YEAR BEGINNING OCTOBER 1, 2007, APPROPRIATING THE SUM OF $863,565.00 TO DEFRAY THE EXPENSES AND LIABILITIES OF THE CITY OF IDAHO CITY FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATION IS MADE.
Be it ordained by the Mayor and City Council of the City of Idaho City, Boise County, Idaho:

ORDINANCE NO. 313
AN ORDINANCE AMENDING TITLE 9, CHAPTER 1, WATER REGULATIONS, AND TITLE 9, CHAPTER 2, SEWER REGULATIONS OF THE CITY OF IDAHO CITY CODE TO INCREASE HOOKUP FEES, AND ADOPTING A NEW SECTION TO GOVERN THE CONSTRUCTION AND USE OF PRIVATE WELLS WITHIN THE CITY LIMITS.
WHEREAS, the city council has determined that the best interests of the public would be served by modifying Idaho City's water and sewer ordinances to increase hookup fees and adopt a new section to govern the use of private wells within the city limits,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Section 9-1-24 (WATER CONNECTION CHARGE) is hereby amended to read as follows:
WATER CONNECTION CHARGE: The owner, or his agent, of all properties connecting to the public water system of the city under the terms of this Chapter shall pay a water connection charge of three thousand five hundred dollars ($3500) for each equivalent connection or fraction thereof as may be assigned to the property by the city.
SECTION 2. That Section 9-2-25 (SEWER CONNECTION CHARGE) is hereby amended to read as follows:
SEWER CONNECTION CHARGE: The owner, or his agent, of all properties connecting to the public sewer system of the city under the terms of this Chapter shall pay a sewer connection charge of three thousand five hundred dollars ($3500) for each equivalent connection or fraction thereof as may be assigned to the property by the city.
SECTION 3. That a new Section, 9-1-35, be included in the Idaho City Code as follows:
PRIVATE WELLS:
A. For the purpose of this section a "private well" is a well that upon its completion is not owned and operated by the City of Idaho City, Idaho.
B. It shall be unlawful for any person to construct a private well in the city without first obtaining approval from the city council.
ORDINANCE NO. 312
AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 1, CHAPTER 5, OF THE CITY CODE, CHANGING THE REGULAR MEETING DATE FOR CITY COUNCIL MEETINGS, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, The City Council has determined that the interests of the Citizens of Idaho City would best be served by regular monthly meetings of the City Council;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Title 1, Chapter 5, Section 1 A. of the Idaho City Code be amended to read as follows:
1-5-1: MEETINGS:
A. Regular Meetings: The Mayor and City Council shall meet in regular session at the City Hall on the fourth Tuesday of each month, such meetings to commence at the hour of seven o'clock (7:00) P.M. During such regular sessions, the Mayor and Council may consider any and all business of the City properly brought before the Council. When a holiday recognized by the City falls on the fourth Tuesday, the regular meeting will be held on the next immediate Wednesday.
SECTION 2. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 310
AN ORDINANCE AMENDING TITLE 9, CHAPTER 1, WATER REGULATIONS, AND TITLE 9, CHAPTER 2, SEWER REGULATIONS OF THE CITY OF IDAHO CITY CODE TO REPEAL THE TERMINATION OF SERVICE PROVISION AND MAKE THE VACANCY RATE APPLICABLE ONLY TO PROPERTIES THAT ARE NOT YET CONNECTED TO CITY WATER AND SEWER SERVICES
WHEREAS, the City Council has determined that the best interests of the public would be served by modifying Idaho City's water and sewer ordinances to eliminate applicability of the "vacancy rate" to any property which has been connected to the City's water and sewer system,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Section 9-1-20 (TERMINATION OF SERVICE) is hereby repealed.
SECTION 2. Section 9-2-23(D) (Vacancy Rate) is hereby amended to read as follows:
Vacancy Rate: A vacancy rate shall be charged upon any sewer hookup that is purchased but is not actually connected to the city sewer system in accordance with the rate schedule adopted by resolution of the city council until such time as the property is connected to the city sewer system. A copy of the current vacancy rate will be on file in the city clerk's office.
SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 309
AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 5, CHAPTER 2, OF THE CITY CODE, PROHIBITING THE CARRYING OF OPEN CONTAINERS OF ALCOHOL ON CITY STREETS EXCEPT WHERE ALLOWED BY PERMIT, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, The City Council has determined that open containers of alcohol should not be carried on City streets except where allowed by permit;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Title 5, Chapter 2, Section 2 of the Idaho City Code be repealed and replaced with the following:
5-2-2: OPEN CONTAINERS OF ALCOHOL:
A. No person shall have or carry an open container or drink of beer, wine, liquor or other alcoholic beverage upon the streets, sidewalks, or alleys of the City of Idaho City except as set forth below.
B. Exceptions; Permits: The governing body may, at any time, upon receipt of proper application, grant permits for the serving, carrying and consumption of alcoholic beverages on City streets and sidewalks for specific events under specified rules. Any permit including the right to serve any such beverages shall comply with the provisions of 3-2-13 of the Idaho City Code requiring a catering permit. Such permits shall be in writing attested by the City Clerk conforming to such requirements as the governing body shall demand, and the permit thus issued shall be subject to revocation at any time by action of the Mayor, the Chief of Police, or designee thereof.
SECTION 2. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 307
AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 5, CHAPTER 5, OF THE CITY CODE, PROHIBITING THE DISCHARGE OF FIREARMS WITHIN THE CITY EXCEPT WHERE ALLOWED BY PERMIT, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, The City Council has determined that the discharge of firearms within the City should be prohibited except where provided for by permit;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Title 5, Chapter 5, Section 1 of the Idaho City Code be repealed and replaced with the following:
5-5-1: FIREARMS:
A. Definitions: Wherever the term "firearms" is used in this Article, the term shall mean any instrument used in the propulsion of shot, shell or bullets or other harmful objects by the action of gunpowder within it, or by the action of compressed air within it, or by the power of springs and including what are commonly known as air rifles and B-B guns.
B. Discharge of Firearms Prohibited: It shall be unlawful for any person to discharge firearms of any kind within the limits of the municipality; provided, however, that this shall not apply to police officers in the discharge of their duties.
C. Exceptions; Permits: The governing body may, at any time, upon receipt of proper application, grant permits to shooting galleries, gun clubs and others for shooting in fixed localities and under specified rules. Such permits shall be in writing attested by the City Clerk conforming to such requirements as the governing body shall demand, and the permit thus issued shall be subject to revocation at any time by action of the governing body and/or the Chief of Police.
SECTION 2. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 306
AN ORDINANCE OF THE CITY OF IDAHO CITY, BOISE COUNTY, IDAHO, AMENDING TITLE 7, ADDING A NEW CHAPTER 3, DEBRIS ON PUBLIC WAYS, PROHIBITING THE DEPOSIT OF SNOW, ICE, OR DEBRIS ONTO ANY PUBLIC SIDEWALK, STREET, OR PROPERTY, ESTABLISHING A PENALTY THEREFORE, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, The City Council finds there is a need to address the issue of snow, ice or other debris being deposited on public ways or properties in order to promote the welfare of the citizens of Idaho City;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That a new Chapter 3 be added to Title 7 of the City Code of the City of Idaho City. The new Chapter 3 shall be titled "Debris on Public Ways."
SECTION 2. That it shall be unlawful for any person to deposit, or cause to be deposited, into the public lane of travel of any public street, sidewalk, public right of way, thoroughfare, or other public property, any snow, ice, dirt, rocks or debris which has accumulated on private property. This provision is not intended to prohibit the removal of snow or ice from private property through reasonable and normal customary removal activities that do not interfere with the regular travel or other use of any such street, sidewalk, or other public property or right of way by the public.
SECTION 3. Penalty: A first violation of this Chapter shall be deemed an infraction, punishable by a fine of twenty-five dollars ($25.00). Any second or subsequent violation within 180 days of a prior violation shall be a misdemeanor. Each such offense is punishable as provided in Section 1-4-1 of this Code.
SECTION 4. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.

ORDINANCE NO. 305
AN ORDINANCE AMENDING TITLE 1, CHAPTER 5, MAYOR AND CITY COUNCIL, OF THE CITY OF IDAHO CITY CODE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF IDAHO CITY, IDAHO:
SECTION 1. That Section 1-5-2 A. (Compensation Mayor) is amended by deleting the phrase "one hundred dollars ($100.00)" and replacing it with the phrase "two hundred dollars ($200.00)."
SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. That this ordinance shall be in full force and effect upon passage, approval and publication according to law.
